Legal
Terms of Service
These terms are the agreement between you and NodinWrite Systems LLC, a Utah limited liability company (“NodinWrite”, “we”, “us”), for the GLASS desktop software, the license keys that unlock it, and this website. They are written to be read. By getting a license key, installing GLASS, or using the site, you agree to them. If you don’t, please don’t use GLASS.
1.What these terms cover
They cover GLASS (the app, every alpha build and update of it), the license key that unlocks it, and nodinwrite.com. License keys are sold and delivered by Creem, our merchant of record: Creem is the seller on your receipt, handles the payment, collects any sales tax or VAT, and issues the invoice. Your purchase is a contract with Creem, which resells GLASS to you in its own name, and Creem’s Buyer Terms take precedence over these terms on any matter of purchase or payment. Our Privacy Policy explains what information we hold and why; it is part of this agreement.
GLASS asks you to accept its End User License Agreement the first time you use it on a computer, and you can read it again from Help ▸ About GLASS. That agreement is the part of these terms that licenses the software, and the two say the same thing.
2.The alpha
GLASS is currently pre-release software. An alpha build is real, usable, and tested, but it is unfinished: features can change, bugs are expected, and a build can be retired when a newer one replaces it. Keep backups of anything you write in it, as you would with any software. We say clearly on the site and in the app which builds are alpha builds.
Alpha license keys are free. We reserve the right to deactivate or revoke any alpha license key at any time, for any reason, with or without notice. Revoking a key stops it activating new computers; an installation already activated keeps running, and GLASS tells you with a banner. Your documents stay on your disk.
3.Your license
A license key gives you a personal, non-exclusive, non-transferable right to install and run GLASS, on Windows and on macOS, on the computers you personally use, up to the number of computers your key allows at one time. One key belongs to one person, and you may keep copies of the installer for your own backup and reinstallation. You may not share, sell, rent, or publish a key; run GLASS for other people as a service; remove or work around the key check; or reverse-engineer, decompile, or modify GLASS except where the law lets you regardless of this clause. We may revoke a key that is being shared or abused. If we do, or if a key ever stops being valid for any other reason, GLASS tells you with a banner, and it never locks you out of your manuscript. Your documents stay on your disk.
A perpetual license. A GLASS license is not a subscription and does not expire: you pay once, and you may use the version your license covers for as long as you wish. A license covers one major version of GLASS (for example, GLASS 1) and every update within it, free of charge. A later major version may be offered as a paid upgrade; upgrading is always your choice, and you never need to upgrade to keep using the version you have. We can’t promise that every version will keep working on every future operating system.
Legacy versions and continuity. We will never remotely disable, time-limit, or lock you out of a version of GLASS you are licensed to use. Once GLASS is activated on a computer, it keeps working without contacting us. We intend to keep current and past installers available to download for as long as we operate nodinwrite.com, but we can’t promise that this website, or NodinWrite itself, will always exist, so please keep a copy of the installer for the version you use. If we ever stop operating the license service, we will first make available a final update, or another means, that lets licensed copies install, activate, and run without it.
4.Your documents
Everything you write in GLASS is yours. Your documents are ordinary files on your own disk; we have no copy of them, no access to them, and no rights over them. GLASS’s proofreading runs on your machine and sends nothing anywhere. You can copy, move, or back up your files at any time, with or without a license key.
5.Pricing, payment, and refunds
The alpha is free. Its price is $0, the checkout asks for no card, and there is no subscription and no in-app purchase. The finished release of GLASS will be a one-time purchase of USD $69, paid once, never a subscription. It is not on sale yet, and alpha writers will be offered a discount on it. The price is shown on this site and at checkout before you pay.
Refunds. If you buy GLASS and it isn’t for you, email support@nodinwrite.com within 14 days of purchase and we’ll refund you in full, no questions asked. Refunds are issued by Creem to the payment method you used. Nothing here limits any statutory right to a refund that applies where you live.
6.Updates and support
GLASS checks for updates once each time it launches and installs one only when you choose to. Support is by email at support@nodinwrite.com or through the Help Center; every message is read by a person, and we reply as quickly as a small team can, usually within a few days. We don’t promise a response time, and we can’t promise to fix every problem, but bug reports are the most useful thing an alpha writer can send us and we treat them that way.
7.Acceptable use
Use GLASS and the site lawfully. Don’t try to break, overload, or gain unauthorized access to the site, the license service, or anyone else’s key. Don’t use automated tools to scrape the site or to request keys in bulk. That’s the whole list.
8.Ownership
GLASS, KILN, the NodinWrite name and marks, and this website belong to NodinWrite Systems LLC. Buying or receiving a license key gives you the right to use GLASS described above, not ownership of the software. GLASS includes open-source components; each is used under its own license, and the notices are included with the app.
9.No warranty
GLASS and the site are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This applies with particular force to alpha builds. Some jurisdictions don’t allow certain warranties to be excluded, so parts of this may not apply to you.
10.Limitation of liability
To the fullest extent the law allows, NodinWrite Systems LLC is not liable for indirect, incidental, special, or consequential damages, or for lost data, lost profits, or lost work, arising from GLASS or the site, however caused. Our total liability to you for any claim is limited to the amount you paid us for GLASS in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
11.Ending the agreement
You can stop using GLASS at any time; uninstalling it and releasing the key from Preferences is all it takes. We can end your license if you materially breach these terms. Ending the agreement never affects your documents: they are files on your disk and stay there. Your license does not otherwise end. The continuity promise in section 3, and sections 4, 8, 9, 10, and 13, survive.
12.Changes to these terms
We may update these terms as GLASS moves from alpha to release. When we do, we change the “last updated” date at the top of this page; for a change that matters to existing license holders, we also say so by email. Continuing to use GLASS after a change means you accept the updated terms, but a change never takes away a right you already have for a version of GLASS you are licensed to use.
13.Governing law
These terms are governed by the laws of the State of Utah and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that email cannot settle is brought in the state or federal courts located in Utah, and both of us consent to their jurisdiction. If you are a consumer, you also keep the protection of any mandatory law where you live. If something goes wrong, write to us first; most things are solved by email.
